Summary

Slimware Utilities Holdings, Inc. ("Slimware Utilities", "we", "us" and "our") respects the privacy of its users and has developed this privacy policy (the "Privacy Policy") to demonstrate our commitment to protecting your privacy. This Privacy Policy is intended to describe for you, as an individual who is a user of the Slimware Utilities websites, software and/or services (collectively the "Services"), the information we collect, how that information may be used, with whom it may be shared, and your choices about such uses and disclosures.

We encourage you to read this Privacy Policy carefully. If you have any questions about our privacy practices, please refer to the end of this Privacy Policy for information on how to contact us. Unless indicated otherwise, Slimware Utilities products and services are subject to this Privacy Policy, Slimware Premium Support is subject to the Terms of Service and for downloadable software products to the End User License Agreement.

A. WHO WE ARE

Slimware Utilities is responsible for your personal information. If you reside in the European Economic Area (“EEA”) our representative is IAC Search and Media Europe Limited. Slimware Utilities is committed to providing you with the best service as well as respecting your privacy - if anything in this Privacy Policy is not clear then please contact us via the methods described below.

B. HOW WE COLLECT INFORMATION

We may collect information from you in a variety of different ways. This is information that may identify you, and anonymous information, such as the number of your page views, link clicks, and login times. Your information may be kept in an identifiable format, or in an aggregate format which means that you cannot reasonably be identified from it. We provide further detail on the type of info we collect, and how we collect it, below:

In addition, we may collect, use and disclose your personal information as required or permitted by applicable law, or as directed by you, in accordance with this Privacy Policy.

  1. Information You Provide To Us: We may collect and store any information you provide when using the Services or that you provide in some other manner. This information may include information such as:
    • Contact information and/or registration information, such as your name; and business and residential mailing address, telephone and facsimile numbers and email address;
    • Information you provided in posting areas and surveys that you have taken with us;
    • Information you provided us while using the Services, including files that you uploaded, and the use of the Services on third-party sites or platforms such as social networking sites;
    • Purchase information, including credit card or payment card information and billing address;
    • Information regarding your use of the Services, such as browsing, downloads and pages viewed;
    • Technical data, associated with any computer or other device you use to access the services, or software therein such as the software and settings on your device and your device identifier or IP address;
    • Such other information we collect with your consent or as permitted or required by law.
  2. Automatically Captured Information. We automatically collect information from your computer and/or device when you use the Services. This allows us to assess how you have used the Services, the device you have used them on and helps us to analyze how we can optimize the Services for you in the future. This information may include:
    • Information about your hardware and software such as your IP address, your browser type and language and other browser-related information, time stamp, access times, current installed applications, system registry settings, driver versions, system start up settings.
    • The content of any of our undeleted cookies, including a unique identifier (see section C on "Cookies" below), software installed upon and/or devices connected to your computer and/or device, and the referring website address.
  3. Other Technologies. We may use standard Internet technology, such as web beacons, cookies and other similar technologies, to track your use of the Services (see our cookies policy). Web beacons are small pieces of data that are embedded in images on the pages of sites. The information we obtain in this manner enables us to customize the services we offer as part of the Services for our users.
  4. Information Collected by Third Parties for Online Advertising. We may allow third parties, including our authorized service providers, parent and subsidiary companies, affiliates, advertising companies, and ad networks, to display advertisements or place ad tags or beacons on or via our Services on the computer or device you use to access our Service and to track that device to over time and across different web sites for the purpose of serving advertising relevant to your interests. We do not control third parties' collection or use of information to serve interest-based advertising.   5. Do not track signals. The systems of the Services are not configured to respond to Web browser "do not track" signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personally information about an individual consumer's online activities over time and across third-party Web sites or online services.

To process your information as described above, we rely on the following legal bases:

  • Provide you with the Services: Most of the time, the reason we process your information is to perform the contract that you have with us. For instance, as you go about using our service, we use your information to provide you with a more customized and personal experience.
  • Legitimate interests: We may use your information where we have legitimate interests to do so. For instance, we analyze users’ behavior on our services to continuously improve our offerings, ensure it is bug free, and we process information for administrative, fraud detection and other legal purposes.
  • Consent: From time to time, we may ask for your consent to use your information for certain specific reasons. You may withdraw your consent at any time by either contacting us at the address provided at the end of this Privacy Policy.

C. COOKIES

When you use the Services, we may assign your computer one or more cookies, to facilitate access to our Services and to personalize your online experience. We, and certain third parties we work with e.g. ad networks and data management platforms, may also use these technologies to better target ads to you based on your online browsing activities.

Our Legal Basis for Cookies and Similar Technologies

  • Placing cookies: in order to place cookies, tags and other technologies on your browser or device, we need to have your permission. We do this by providing a clear notice in the form of a cookie banner that tells you what cookies are used for, as well as providing you with useful information about the technologies we use and a link to this policy. You'll need to indicate your acceptance of our use of cookies. On a mobile device this might be by swiping a banner or pressing a button. You are able to opt-out of the use of cookies.   • Using information collected from cookies: where we want to use the information that cookies and similar technologies collect, we either obtain your consent or we maintain a legitimate interest in doing so.

What Cookies Do We Use and Why?

  • Strictly Necessary Cookies and Similar Technologies: these are vital for the running of our Services. Without the use of these cookies, parts of our Services would not function.
  • Analytics Cookies and Similar Technologies: these collect information about your use of our Services, and enable us to improve the way they work. For example, analytics cookies show us which are the most frequently visited pages on our websites. They help us record how you interact with our Services, such as how you navigate around pages and from page to page, identifying improvements we can make to the customer journey. They also help identify any difficulties you have accessing our services, so we can fix any problems. Additionally, these cookies allow us to see overall patterns of usage at an aggregated level.
  • Functional/Preference Cookies and Similar Technologies: these cookies collect information about your choices and preferences, and allow us to remember things like language, text size, and location, so we can show you relevant content to where you are. They allow us to customise the services you have accessed. We also use these cookies to provide you with services such as video clips.
  • Tracking, Advertising Cookies and Similar Technologies: we use these types of technologies to provide advertisements that we think may be more relevant to your interests. This can be done by delivering online adverts based on your previous web browsing activity, known as "online behavioural advertising" (“OBA”). Cookies are placed on your browser which will remember the websites you have visited. Adverts based on what you have been looking at are then displayed to you when you visit websites which use the same advertising networks.

We may also use cookies and similar technologies to provide you with adverts based on your location, offers you click on, and other similar interactions with our websites and apps. To help us deliver relevant advertising using cookies, we use Google products including Google Marketing Platform. You can find out more here.

Web Beacons and Tracking Pixels: these are bits of data that count the number of users who access a website or webpage and can also allow us to see if a cookie has been activated. Web beacons are also used to verify any clicks through to links or advertisements. We may use this information to inform advertisers how many customers have clicked on their adverts (the information shared with advertisers is aggregated and does not identify you individually).

Tracking URLs: tracking URLs are a special web link that allows us to measure when a link is clicked on. They are used to help us measure the effectiveness of campaigns and advertising.

How We Use Cookies And Similar Technologies

  • Protect our networks: cookies and similar technologies help us identify and prevent threats to our sites. They are necessary to protect your information and our business from outside threats.
  • Allow you to access our services: cookies and similar technologies permit your connection to our websites: our servers receive and record information about your computer, device, and browser, including potentially your IP address, browser type, other software or hardware information, and your geographic location.
  • Access usage of services: we use information about your usage of our services and websites, such as the pages you have visited and content you have viewed to assess how our services are used.
  • Provide ecommerce functionality: cookies and similar technologies help us provide functionality that you need to navigate our sites, select products and services and purchase them.
  • Provide relevant content: the content for Services may be adjusted depending on what we know about the content, products and services that you like. This means we can highlight content we believe will be of interest to you. We provide personalisation by using cookies, IP addresses, web beacons, URL tracking and mobile app settings.
  • Selling third party advertising: we sell space on our websites and apps to advertisers. The adverts they display on our websites will often contain cookies. Our advertisers may use cookies or similar technologies to provide you with advertisements that they believe are relevant. They may use browsing data obtained to restrict the number of times you see particular adverts (frequency capping). You may also see adverts from these advertisers on other websites you visit.

Third parties that support our Services by serving advertisements or providing other services, such as allowing you to share content or tracking aggregate service usage, may also use cookies and other technologies to collect information relevant to the provision of those services. We do not control third party cookies or other technologies. Their use is governed by the privacy policies of third parties using such technologies. When you visit our sites for the first time you will see notices about the use of cookies by us and our partners. You'll be able to learn more about the specific cookies in use and how to control them. We will remember your preferences and may ask you periodically to confirm these. You are able to change your preferences at any time by scrolling to the bottom of the website page you are visiting and clicking on ‘Manage Privacy’.

Importantly, these ad networks set cookies to remember that you have chosen to opt-out. If you clear your cache the opt-outs will not be applied and you would need to opt-out again.

D. HOW WE USE THE INFORMATION WE COLLECT

We may use information that we collect about you to:

  • Deliver Services and information that you have requested and otherwise allow you to fully participate in the interactive features of our Services;
  • Notify you about your account, including expiration and renewal notices;
  • Provide you with customer support;
  • Perform research and analysis about your use of, or interest in, our products, services, or content, or products, services or content offered by others;

E. WITH WHOM WE SHARE YOUR INFORMATION

We share your information with others as indicated below:

  1. Authorized service providers: We may share your information with our authorized service providers that perform certain services on our behalf. These services may include:
    • providing customer service, technical and operational support, and email services;
    • marketing assistance, performing business and sales analysis, billing and payment processing (if we ever accept payments from our users),
    • supporting our Services functionality, and supporting contests, sweepstakes, surveys and other features offered through our Services, as well as when we have notified you, or you have requested, that we do so.
    These service providers may have access to information, which is needed to perform their functions and provide you with the Services. These service providers may have access to Personal Information, which is needed to perform their functions, but are not permitted to share or use such information for any other purposes. These service providers may email or otherwise contact you solely as may be necessary to provide the Services that you have requested or consented to receive from us. Moreover, these service providers may collect usage data (i.e., data relating to your use of the Services) and share usage data in aggregate and anonymous form.
  2. Other IAC businesses: We are part of the IAC family of businesses (www.iac.com). We may share information we collect with our affiliated IAC companies. Sharing information with our IAC affiliates enables us to provide you with information about a variety of products and services that might interest you.
  3. Other Situations: We may disclose your information (i) in good faith compliance with a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency, (ii) in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; (iii) to protect and defend the rights, property or safety of our company, our users, our employees, or others; (iv) to comply with applicable law or cooperate with law enforcement; (v) to enforce our Services terms and conditions or other agreements or policies; and (vi) in connection with a substantial corporate transaction, such as the sale of our business or the Services (or a majority of the assets of either), a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy. In addition, we may share aggregated information we collect, under any of the above circumstances, with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis.

F. HOW LONG WE KEEP YOUR INFORMATION

We only keep your personal information as long as it is necessary for the purposes set out in this Privacy Policy including for legitimate business purposes and as permitted by applicable law. We will only use your information to the extent necessary to comply with our legal obligations, resolve any legal issues, enforce our agreements, and as otherwise described in this policy.

G. WHERE WE STORE YOUR INFORMATION

Information we collect, or permit third parties to collect, may be transferred to, stored and processed outside your country of residence in any country or territory where one or more of our affiliated group companies, third party service providers or advertising companies or advertising networks are located or maintain facilities, including but not limited to the United States, India, and Ukraine.

When your information is moved from your home country to another country, we ensure that such a transfer is done legally. For users based in the EEA, we may rely on the “Model Clauses” a standard document created by the European Commission to facilitate data transfers while ensuring that safeguards are put in place for personal information. We do not participate in the “EU-US Privacy Shield” but we may rely on it to transfer personal information to some of our service providers based in the USA, provided they are certified to receive such personal information pursuant to the Privacy Shield. By using the Services, you consent to the transfer of your personal information as described in this Privacy Policy.

H. YOUR RIGHTS

Depending on your location you may have some or all of the following rights in relation to how we use your information:

  • Access: you may request access to your information and receive copies of it.
  • Correction: to have inaccurate/incomplete information corrected and updated.
  • Object to, or Limit or Restrict, Use of your Information: You can ask us to stop using all or some of your information or to limit our use of it.
  • Deletion: in certain circumstances, you can request a right “to be forgotten” (this is a right to have your information deleted or our use of your information restricted, including for example, a right to not have a user’s name appear in a search result). We will honor such requests unless we have to retain this information to comply with a legal obligation by European or Member State law or unless we have an overriding interest to retain it.
  • Portability: in certain circumstances, exercise the right to data portability (this is a right to obtain a transferable version of your information to transfer to another provider).
  • Consent Management: Where we rely on consent to process your information, you may withdraw consent at any time, and you do not have to provide a reason for your withdrawal.

If you wish to exercise any of these rights or wish to object to our use of your information, please write to us at the address listed below and we will consider your request in accordance with applicable laws. Keep in mind, we may reject requests for certain reasons, including if the request is unlawful or if it may infringe on the rights and freedoms of another person.

I. HOW WE PROTECT YOUR INFORMATION

The security and confidentiality of your information is very important to us; thus, we take certain security measures (including physical, electronic and procedural measures) to help safeguard your information from unauthorized access and disclosure. Please know that, despite our best efforts, no security measures are perfect or impenetrable.

J. CHILDREN'S PRIVACY

Our Services are intended for general audiences over the age of 18 years old. We do not knowingly collect information from children under the age of 18 years old. If you are not over 18 years old, then DO NOT DOWNLOAD OR USE THE SERVICES.

K. NO RIGHTS OF THIRD PARTIES

This Privacy Policy does not create rights enforceable by third parties or require disclosure of any information relating to users of the Services.

L. CHANGES TO THIS PRIVACY POLICY

We will occasionally update this Privacy Policy to reflect changes in our practices and services. When we post changes to this Privacy Policy, we will revise the "Last Updated" date at the top of this Privacy Policy. If we make any material changes in the way we collect, use, and/or share your information, we will notify you by posting notice of the changes on or through the applicable Services, or notifying you of these changes in another way reasonably calculated to provide notice. We recommend that you check this page or the help menu within our products from time to time to inform yourself of any changes in this Privacy Policy or any of our other policies.

We may acquire or develop new Slimware Utilities products and/or Services from time to time that require additional privacy disclosure. In such case, we will add these additional provisions in a product specific annex or section that will only apply to such new Slimware Utilities product or Service and will not vary the terms of this Privacy Policy in relation to your use of existing Slimware Utilities products and Services (and, as such, we will not be required to notify you of such additional terms unless you also use the new Slimware Utilities products or the Services).

M. INFORMATION FOR RESIDENTS OF CALIFORNIA: YOUR CALIFORNIA PRIVACY RIGHTS

If you are a California resident, the California Consumer Privacy Act (“CCPA”) may provide you with additional rights regarding our use of your personal information. The CCPA Notice applies to “Consumers” as defined by the law. This section describes your CCPA rights as a California Consumer and explains how to exercise those rights.

Access to Information and Data Portability Rights

You have the right to send us a request, no more than twice in a twelve-month period, for any of the following for the period that is twelve months prior to the request date:

  • The categories of personal information we have collected about you.
  • The categories of sources from which we collected your personal information.
  • The business or commercial purposes for our collecting or selling your personal information.
  • The categories of third parties to whom we have shared your personal information.
  • The specific pieces of personal information we have collected about you.
  • A list of the categories of personal information disclosed for a business purpose in the prior 12 months, or that no disclosure occurred.
  • A list of the categories of personal information sold about you in the prior 12 months, or that no sale occurred. If we sold your personal information, we will explain:
    • The categories of your personal information we have sold.
    • The categories of third parties to which we sold personal information, by categories of personal information sold for each third party.

You have the right to make or obtain a transportable copy, no more than twice in a twelve-month period, of your personal information that we have collected in the period that is 12 months prior to the request date and are maintaining.

Data Deletion Rights

Except to the extent we have a basis for retention under CCPA, you may request that we delete your personal information that we have collected directly from you and are maintaining. Note also that we are not required to delete your personal information that we did not collect directly from you.

Exercising Your Rights

To make a request for access, portability or deletion according to your rights under CCPA, click here or mail your request for the attention of the Privacy / Legal Department to Slimware Utilities Holdings, Inc., 555 West 18th Street, New York, NY 10011. California Consumers may exercise these rights via an authorized agent who meets the agency requirements of the CCPA. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Any request you submit to us is subject to an identification and residency verification process (“Verifiable Consumer Request”).

The Verifiable Consumer Request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Some personal information we maintain about Consumers is not sufficiently associated with enough personal information about the Consumer for us to be able to verify that it is a particular Consumer’s personal information (e.g., clickstream data tied only to a pseudonymous browser ID). As required by the CCPA, we do not include that personal information in response to Verifiable Consumer Requests. If we cannot comply with a request, we will explain the reasons in our response.

We will make commercially reasonable efforts to identify Consumer personal information that we collect, process, store, disclose, and otherwise use and to respond to your California Consumer privacy rights requests. We will typically not charge a fee to fully respond to your requests, but we may charge a reasonable fee, or refuse to act upon a request, if your request is excessive, repetitive, unfounded, or overly burdensome.

We do not “sell” personal information that we collect from you, in accordance with the definition of “sell” in the CCPA and will treat personal information we collect from you as subject to a do not sell request. There is not yet a consensus as to whether third-party cookies and tracking devices associated with our websites may constitute a “sale” of your personal information as defined by the CCPA. You can exercise control over browser-based cookies by adjusting the settings on your browser.

We will not discriminate against you in a manner prohibited by the CCPA because you exercise your CCPA rights. However, we may charge a different price or rate, or offer a different level or quality of good or service, to the extent that doing so is reasonably related to the value of the applicable data.

California's "Shine the Light" law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses' practices related to disclosing personal information to third parties for the third parties' direct marketing purposes. N. YOUR NEVADA RIGHTS

Under Nevada law, Nevada residents may opt out of the “sale” of certain “covered information” (as defined under Nevada law) collected by operators of websites or online services. We currently do not sell covered information, as “sale” is defined by Nevada law, and we do not have plans to sell this information. However, if you would like to be notified if we decide in the future to sell personal information covered by the Act, please contact us here. You are responsible for updating any change in your email address by the same method and we are not obligated to cross-reference other emails you may have otherwise provided us for other purposes. We will maintain this information and contact you if our practices change.
